1. Dangerous chemicals ≠ dangerous goods

In recent years, personal injuries and property losses caused by under-reporting, misreporting, and under-reporting of dangerous goods have emerged one after another. Many people confuse dangerous chemicals and dangerous goods in customs declarations. These two concepts are both similar and different, and the scope of coverage is both overlapping and different.

the difference:

Dangerous chemicals only contain chemical substances, and dangerous goods contain substances and articles, both of which have special requirements for packaging. Therefore, some dangerous goods are not classified as dangerous chemicals, such as lithium batteries, storage batteries, matches, car airbags, etc.

In the classification principle of hazardous chemicals, many chronic hazards that endanger health and the environment (such as carcinogenicity, reproductive toxicity, germ cell mutagenicity) have not been adopted by the classification standards for dangerous goods. Therefore, some hazardous chemicals are not classified as dangerous goods, such as boric acid.

2. Customs supervision requirements

Hazardous Chemicals:

In accordance with the "Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China", the "Regulations on the Safety Management of Hazardous Chemicals", the former General Administration of Quality Supervision, Inspection and Quarantine "Announcement on Issues Concerning Import and Export of Hazardous Chemicals and Their Packaging Inspection and Supervision" (2012 No. 30) ) And other relevant regulations, the products in the "Catalogue of Dangerous Chemicals" (2015) are statutory inspection commodities.

The customs adopts the supervision mode of "port inspection and destination inspection" for imported hazardous chemicals, and the consignee or agent of imported hazardous chemicals shall declare to the customs.

The customs adopts the supervision requirements of "origin inspection and port inspection" for export of hazardous chemicals. The consignor or his agent of exporting hazardous chemicals shall apply to the customs of the place of origin for an electronic account.

Dangerous goods:

Supervise in accordance with "The Import and Export Commodity Inspection Law of the People's Republic of China" and its implementation regulations.

Both packaging:

Enterprises that export dangerous goods (hazardous chemicals) packaging containers shall apply to the customs of the place of origin for the performance appraisal of dangerous goods (hazardous chemicals) packaging containers. Enterprises that export dangerous goods (hazardous chemicals) should apply to the customs of the place of origin for the use of dangerous goods (hazardous chemicals) packaging containers.

The customs conducts "origin inspection" on the packaging of exported dangerous goods (hazardous chemicals), and after passing the customs inspection, the "Outbound Goods Transport Packaging Performance Inspection Result Form" and the "Outbound Dangerous Goods Transport Packaging Use Appraisal Result Form" are issued respectively.

3. How to declare hazardous chemicals?

(1) Scope of application

According to the "Implementation Regulations of the Import and Export Commodity Inspection Law of the People's Republic of China", "Regulations on the Safety Management of Hazardous Chemicals", "Announcement on Issues Concerning Import and Export of Hazardous Chemicals and Their Packaging Inspection and Supervision" (formerly AQSIQ 2012 No. 30 Announcement) and other relevant regulations, the products listed in the "Dangerous Chemicals Catalog" are all statutory inspection commodities.

(2) Application materials

Declare imported materials

(1) Declaration of conformity of import hazardous chemicals business enterprise;

(2) For products that need to add inhibitors or stabilizers, the name and quantity of the actual inhibitors or stabilizers should be provided;

(3) Samples of Chinese hazard publicity labels (excluding bulk products) and Chinese safety data sheets.

Note: The above-mentioned materials that involve multiple declaration batches and need to be used multiple times are allowed to be provided by the enterprise only during the first declaration, and reused in subsequent periods. The original documents for customs verification shall be provided as required.

Declare export materials

(1) Declaration of conformity of export hazardous chemicals production enterprises;

(2) Classification and identification report of hazardous characteristics;

(3) Samples of hazard announcement labels and safety data sheets, if they are samples in foreign languages, corresponding Chinese translations should be provided;

(4) For products that need to add inhibitors or stabilizers, the name and quantity of the actual inhibitors or stabilizers should be provided;

(5) For dangerous goods, the "Entry-Exit Goods Packaging Performance Inspection Result Form" is required (except for bulk products)

Note: The above-mentioned materials 1-4 involve multiple declaration batches and documents that need to be used multiple times. Enterprises are allowed to provide them only when they declare for the first time. If they are reused later, if the customs needs to verify the original documents, they will be provided as required. Item 5 "Entry-Exit Goods Packaging Performance Inspection Result Form" needs to be provided and written off by the customs.

Check "Electronic Account" in the required documents field to prepare for port customs clearance inspection;

For dangerous goods, it is also necessary to apply to the customs of the place of origin with relevant materials to appraise the use of export dangerous goods packaging. After passing the inspection, obtain the "Appraisal Result Sheet for the Use of Export Dangerous Goods Transport Packaging".
